Online Auction Terms and Conditions
1.The highest internet bid for each lot will be used as a proxy bid at the live auction. All high bidders at the close of the online auction will be the starting bid at the live auction.
2. By placing a bid on an item sold at our online auction, the bidder agrees to pay the bid amount, plus all fees applicable. The bidder will not and cannot cancel a bid placed after the bidder has confirmed the bid. All sales are final.3. All online bidders must complete a credit card authorization form at the time of registration. The form must be faxed to Wayne Evans Auction Co., Inc. at (706) 324-0354 before the registration process can be completed. After the form has been received, Wayne Evans Auction Co., Inc. will then authorize the bidder. The bidder will receive a user name and password in order to log into the online auction, via the e-mail address provided.
4. Only Visa & Master Card Credit Cards will be accepted as payment for online auction bidders. If you are the highest bidder at both the online & live auctions, The City of Tulsa will charge your card for the full amount due as soon as the live auction is completed. The buyer will then be notified via e-mail of all items purchased.
5. While descriptions are believed to be accurate, the auctioneer and seller make no warranties or guarantees, expressed or implied. Wayne Evans Auction Co., Inc. will not be held responsible for any advertising discrepancies or inaccuracies. Everything is sold "AS-IS" and "WHERE-IS". All sales are final. No warranties are made as to the merchantability of any items or their fitness for any purpose.
6. It is the buyer's sole responsibility for the removal and shipping of the equipment and inventory and must supply their own handling of equipment and personnel. The buyer must repair/replace any damage that occurs during removal. It is the buyer's responsibility to secure all safety equipment to meet all applicable government safety standards in using or removing items purchased. Shipping will not be available.
7. If any shortages exist on counts, an adjustment will be made only if claims are made at the time of removal. No adjustments as to counts will be allowed after purchased item(s) are removed from the premises.
8. This is a 0% Buyer's Premium auction. The online bidder will be subject to a 8.517% local sales tax at the time payment is made.
9. Purchaser does hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal or shipping of items purchased.
10. The seller and auctioneer shall have no liability to the buyer of any lot for non-delivery or any purchased item(s), other than the buyer's deposit or payment on the lot.
11. In the event the purchaser fails to pay for the entire purchase within the time set forth by the auctioneer, and/or fails to comply with any of the conditions or terms of sale, the seller may retain and/or recover any monies paid as part of its damages and, in addition thereto, items that are not paid for can be resold at public or private sale without further notice. Any deficiency resulting from such resale shall be due to the auctioneer by the defaulting purchaser together with all charges, fees, and expenses including reasonable attorney fees incurred by such resale and enforcement of the obligation hereunder. All Sales Are Final.
12. No item can, on any account, be removed prior to full payment. Removal shall be at the expense, risk, and liability of the purchaser. Auctioneers shall not be responsible for items not removed within the time allowed when applicable. If items are not removed within the specified removal time, the purchaser shall be liable for any moving and/or storage costs incurred and, if not so removed, the items shall be deemed abandoned and sold. The purchaser will have one (1) week after the auction closes in order to remove the items purchased. All items must be removed no later than Friday May 9th.
13. All Absentee bids, must be placed in writing along with the bidder's signature, copy of driver's license, contact informaton (physical address, phone number, e-mail address), lot number and bid amount. Once an absentee bid has been placed, it can not be removed. All Sales Are Final.
14. The terms and conditions located in the lot description apply to only that particular lot.

Live Auction Terms & Conditions
1. This is a 0% Buyer's Premium Auction.
2. Payment Methods: Cash, cashier check, money order, Credit Cards (Visa or MasterCard ONLY). All personal or company checks must be made out to The City of Tulsa and will only be accepted when accompained by a valid bank letter of guarantee printed on the banks letter head. (Click Here For An Example).
3. All sales are subject to applicable local and state tax laws; unless the proper sales tax permit is provided and proof of regular engagement in the resale business for items purchased. An Oklahoma Tax Commission Auditor will be present on sale day.
4. All purchases must be paid in full no later than one (1) hour after the end of the auction. Equipment will not be released until full payment of all items purchased has been received.
5. All Equipment is sold "As-Is" and "Where-Is." The City of Tulsa and Wayne Evans Auction Co., Inc. makes no guarantees as to condition, operation, or safety of such.
6. Successful bidders will be responsible for all loading and transporting of equipment from the lot.
7. All vehicles and equipment may be operated in position. Do not remove any vehicle or piece of equipment. Any damage or injury resulting from unauthorized movement shall be operator's responsibility.
8. All items purchased must be removed by the buyer on sale day, unless other arrangements are made with the surplus coordinator. Failure to remove your purchases as specified or within the time agreed upon will result in forfeiture without refund and ownership will revert to the City of Tulsa, OK. The City of Tulsa and/or Wayne Evans Auction Co., Inc. does not provide loading services and assumes NO responsibility for any accidents while on City of Tulsa property.
9. The City of Tulsa reserves the right to add or remove any piece of equipment from this auction.
10. Due to insurance restrictions, no person(s) under 16 years of age will be admitted.
11. Once an item has been sold to a buyer, the item can not be changed to another bidder.
12. All titles will be transfered into the name as stated on buyer registration card filled out at the time of registration. All titles will be given out on sale day, if purchaser visits the title office with the proper paper work received at the auction.Note: There will be 2 auctions taking place simultaneously.
